Final Market Analysis Document for Access to Mobile Networks and Call Initiation Published

As a result of the 4th round market analysis studies conducted within the scope of the Access to Mobile Networks and Call Initiation Market, the final market analysis document has been approved by the Information Technologies and Communication Authority with the Authority Decision dated 12.04.2017 and numbered 2017/DK-SRD/124, and has been published on our Institution's website (You can access the relevant document from the

Pursuant to Article 13, paragraph 2 of the Market Analysis Regulation, it has been deemed appropriate that a one-year transition period may be determined following the approval of the Access to Mobile Networks and Call Initiation Market (Final Document) by the Information Technologies and Communication Authority (Authority) in order to ensure the effective progress of competition in the relevant market, to provide a predictable regulatory environment for all operators providing services in the market or concerned with the relevant market, and to enable the said operators to prepare their commercial operations to adapt to this development. It has been evaluated that it would be beneficial to closely monitor the relevant market together with closely related markets during this period or following deregulation, depending on future market developments, particularly if the convergence trend observed in market shares reverses and moves towards a non-competitive structure, if effective market entries are hindered by anti-competitive practices within the scope of refusal to deal, if anti-competitive practices based on pricing such as predatory pricing are observed, or if potential anti-competitive situations such as unexpected tariff policy changes and pricing developments arise, the regulatory conditions may be reviewed again by our Institution, primarily including a standalone SMP or joint SMP assessment in the relevant market.
In light of these evaluations, during the one-year transition period that will begin with the approval of the final document by the Authority, the obligations imposed on Turkcell İletişim Hizmetleri AŞ (Turkcell), which was designated as having SMP as a result of the previous market analysis, with the Authority Decision dated 18/02/2013 and numbered 2013/DK-SRD/105, will remain in force. At the end of the transition period, taking into account market developments, unless otherwise decided by the Authority, the relevant market will be deregulated and the following obligations imposed on Turkcell with the said Authority Decision will be lifted:
• Provision of access and interconnection,
• Non-discrimination,
• Transparency,
• Preparation and publication of reference access offers,
• Being subject to tariff control,
• Accounting separation and cost accounting, and
• Co-location
obligations will be removed.
